Advertiser agreement

This Advertiser agreement is between Dark Media EU LTD / Models World (“Company”, “we”) and you (“Advertiser”) — whether you list yourself or you represent others. It applies when you create an advertiser account, pay for a plan, or publish listing content on Models World.

By registering, paying, or posting, you accept this Agreement and our Terms, Privacy policy, Safety rules, 2257 statement, and DMCA policy. We may revise this Agreement by posting an update; continued use after notice means acceptance. If you disagree with a material change (including pricing), stop placing new ads and close the account as allowed below.

1. Acceptance

Only adults who accept this Agreement may use advertiser services. Nobody is authorized to post listings without acceptance. Electronic acceptance (checkbox, payment, or publish) is binding.

2. Content, payments, refunds, and accounts

• You may post listing content only after account approval and payment of applicable fees for the plan you choose.
• If US law applies to you, you warrant compliance with applicable federal and state advertising and record-keeping rules for your content.
• You are solely responsible for producing, publishing, and maintaining your content and for anyone posting on your behalf.
• You must not create an account where using the site would violate local law. You are responsible for all activity on your account, authorized or not; keep credentials secure.
• Plan prices and features are shown at checkout / pricing. Fees are generally non-refundable once a listing period has started, except where required by law or where we cancel a paid placement without cause.
• Account data is handled under our Privacy policy.

3. License to Company

You grant Company a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, display, reproduce, distribute, and promote your submitted content on Models World and affiliated outlets for the purpose of operating the directory — for as long as the content remains on our systems, and as needed for backups, legal compliance, and dispute handling. We do not owe you royalties for that license. We are not required to police third-party copying of your content. This Agreement does not let you use Company trademarks except as needed to link to your own listing. You may authorize an agent in writing; you remain responsible for their acts.

4. Your warranties and indemnity

You represent and warrant that:

• You own or control all rights needed to grant the licenses above;
• Content is original or properly licensed and does not infringe others’ rights;
• Every person depicted was a consenting adult (18+, or older if required where photographed) at the time of creation, and photos truly show that person;
• If you post for others, you actually employ or represent them and have authority to advertise them;
• You keep valid ID / age documentation for persons depicted as required by law and Company policy;
• Content is lawful, does not solicit illegal activity, and does not promote trafficking, exploitation of minors, or other prohibited conduct — Models World has a zero-tolerance policy on those;
• Business and contact details you provide are accurate;
• You will defend and indemnify Company and its affiliates against claims arising from your content, account, or breach of this Agreement.

Submitting violating content may lead to removal, account termination, forfeiture of fees, and referral to authorities where appropriate.

5–6. Liability limits

Company is not liable for loss of your content, acts of site users or people who respond to ads, or off-platform meetings. Services are provided “as is.” To the maximum extent allowed by law, Company is not liable for indirect, incidental, special, or consequential damages. Our aggregate liability related to advertiser services is limited to fees you paid us for the affected listing period in the three months before the claim.

7. Company’s role

You are the creator/producer of your content. Company operates an interactive computer service / advertising platform that hosts third-party listings; we do not endorse services advertised. You must prevent minors in your care from accessing inappropriate material through your systems.

8. Publishing standards

• We do not accept advertising from or for anyone under 18.
• We do not create your listing content for you.
• We may refuse or remove images or copy that solicit unlawful conduct or that we deem sexually explicit video beyond our policies.
• We may edit, refuse, or remove listings that violate this Agreement or site policies.

9. Documents and verification

Advertisers must upload a clear photo of a government-issued color ID when we request it (or as part of verification). If a listing photo does not clearly show the face, we may require additional proof. “Verified” / ID-on-file is a label based on documents we accept; it is not a guarantee of character or services.

10. Miscellaneous

• Content you submit is not confidential except as stated in Privacy.
• This Agreement is governed by the laws of Switzerland (excluding conflict-of-law rules), unless a mandatory local consumer rule applies.
• You and Company are independent contractors.
• Either party may terminate for material breach. We may suspend or terminate for policy violations immediately.
• If a provision is unenforceable, the rest remains. Waiver of one breach is not a waiver of others. Force majeure applies except to fee payment.
• Notices to Company: [email protected] (email only). Surviving sections include licenses, warranties, indemnity, and liability limits.
